MISSOURI ā September 23, 2026
Missouri voters will face a major constitutional question on the November 3, 2026, general-election ballot concerning abortion access, reproductive healthcare, parental consent for minors, and medical procedures for transgender minors.
The measure is officially designated Amendment 3. It would repeal the reproductive-rights provision Missouri voters approved in 2024 and replace it with a different constitutional framework governing abortion and related issues.
What Would Amendment 3 Change?
According to the Missouri Secretary of Stateās official ballot language, a āyesā vote would:
⢠Repeal the 2024 constitutional provision providing reproductive healthcare rights, including abortion access through fetal viability.
⢠Allow abortions in cases of medical emergency.
⢠Allow abortions involving rape or incest before 12 weeksā gestation.
⢠Allow abortions in cases involving fetal anomalies.
⢠Allow the Missouri Legislature to enact laws regulating abortion.
⢠Require parental or judicial consent for minors seeking an abortion.
⢠Prohibit certain gender-transition procedures for minors, including specified surgeries, cross-sex hormones and puberty-blocking drugs, with stated exceptions.
⢠Restrict public funding of abortions except in limited circumstances.
A ānoā vote would leave the 2024 constitutional reproductive-rights provision in place.
Under the official ballot language, that provision would continue to allow abortion access through fetal viability, subject to the constitutional provisions and exceptions currently in effect.
What Is the Current Constitutional Framework?
Missouri voters approved a reproductive-rights constitutional amendment in November 2024.
That amendment established a constitutional right to make decisions concerning reproductive healthcare, including abortion and contraception, and provided protections against governmental interference with those rights.
It also allowed abortion to be restricted after fetal viability, subject to the constitutional protections established by the amendment.
Amendment 3 would repeal Article I, Section 36, and replace that framework with the restrictions and exceptions described in the 2026 proposal.
The 2026 ballot measure would instead establish specific circumstances in which abortion would remain permitted, including medical emergencies, certain fetal anomalies, and rape or incest before 12 weeksā gestation.
Amendment 3 was proposed by the Missouri General Assembly and has been certified for the November 3, 2026, general election.
Because the proposal would change the Missouri Constitution, the final decision will be made directly by Missouri voters.

What Should Missouri Voters Know?
Amendment 3 is a constitutional amendment concerning abortion access and other healthcare-related provisions, rather than simply an ordinary change to state law.
The official ballot language explains what would happen under either a āyesā or ānoā vote. Voters can review the complete proposal and the stateās official ballot language before making their own decision. (Missouri Secretary of Stateā ļæ¼)
